1) What this document covers

These Terms govern your use of Zeyn, a focus-first desktop editor for novel writers (the “Service”), currently offered as a desktop app (v1, offline/local) and, in the future, optional Cloud Sync and AI features. Sections that apply only when you enable Cloud/AI are clearly marked.

A separate Privacy Policy explains how we process personal data. If you use app stores/third-party channels later, their terms may also apply.

2) Eligibility & Accounts

  • Individuals only. Zeyn provides individual accounts. No organization/workspace features.
  • Minimum age. You must be 16+. We don’t target minors.
  • Global availability; restrictions. We may restrict access where prohibited by law, sanctions, or export controls (see §13).
  • Your information. You must provide accurate information and keep credentials confidential. You are responsible for activity under your account.

3) License & Ownership

  • Your content is yours. You own your manuscripts, notes, chapter structures, and stats (“User Content”).
  • License to operate the Service. You grant Zeyn a limited, revocable, non-exclusive, worldwide, royalty-free license to host, back up, process, index, and transmit User Content solely to provide the Service (including Cloud/AI, if you enable them), and to create aggregated/anonymized analytics that do not identify you.
  • Software license (app). We grant you a personal, revocable, non-transferable license to install and use the desktop app for your own writing, subject to these Terms and any plan limits.
  • Open-source/third-party components. Zeyn may include third-party and open-source software under their respective licenses.

4) Plans, Lifetime Deal (LTD), Trials & Subscriptions

  • LTD (v1, offline). The LTD applies to Zeyn v1 desktop, offline/local features and includes updates and bugfixes for v1.x. It does not include future Cloud Sync or AI usage; those may require separate paid plans or metered credits. LTD is personal and non-transferable.
  • Free trial. A 7-day trial may be offered and auto-converts to a paid plan unless canceled before the trial ends. Trial excludes AI features.
  • Subscriptions (future). Monthly/annual subscriptions auto-renew until canceled. We will give at least 1 month notice for price changes.
  • Usage-based pricing (future). Cloud Sync and AI may use metered tokens/credits and may have caps or overage fees; we’ll disclose limits in the product or plan page.
  • Where & how you pay. Direct sales via our website (paywall). Payments processed via Stripe and/or EasyCart. Currencies: EUR, USD. Prices shown include VAT where applicable; VAT is itemized on invoices. Invoices/receipts are issued (e.g., via inFakt).
  • Refunds & EU withdrawal. We honor applicable consumer laws, including the EU 14-day right of withdrawal. If you choose immediate download/activation, you may be asked to expressly consent to supply and acknowledge loss of withdrawal right for that item; if you prefer to retain the right, do not request immediate supply until 14 days pass. 5) Acceptable Use Policy (AUP)

You agree not to:

  • violate laws; infringe IP rights or privacy; upload illegal content;
  • harass, dox, threaten, or promote harm;
  • introduce malware; attempt to reverse-engineer or bypass security or technical restrictions;
  • circumvent geo-blocking, sanctions, or plan limits;
  • spam, scrape at scale, or abuse API/AI features;
  • use AI features to generate unlawful or harmful content.

Security testing is allowed only with prior written permission.

6) Telemetry, Support, and Updates

  • Telemetry now. We collect limited usage analytics and crash reports (e.g., PostHog, Sentry) to improve stability and UX. See Privacy Policy for details.
  • Support. Email support via rafal@piekara.me. Target response: 48 hours; P0 incidents within 12 hours (business-hours best-effort).
  • Updates. The app may auto-update; you may also download updates manually. We may push mandatory security updates. Version pinning is not guaranteed.

7) Local-Only v1 (today)

  • Storage. Your manuscripts and settings are stored locally (e.g., SQLite, local storage, Markdown files). The app reads only the folders you choose for backups/exports.
  • Encryption. We recommend enabling OS-level disk encryption. The app may include additional local encryption or passcode features; see in-app settings.
  • Backups. You control local backups/export. You are responsible for safeguarding your files unless you enable future Cloud Sync.

8) Cloud Sync (future; active only if you enable it)

  • Scope. If you enable Cloud Sync, we will store and sync User Content (manuscripts, stats, settings) using providers such as Supabase and Cloudflare (R2/S3-like storage).
  • Security. Data is encrypted in transit and at rest by our providers. We may maintain daily backups with a target 30-day retention (non-binding target).
  • Location & transfers. Data may be processed or stored outside your country (no EU-only commitment at present). We will maintain an up-to-date list of subprocessors and notify users of material changes where required.
  • Deletion & export. You can request data export and deletion; we aim to fulfill deletion within 30 days, subject to legal and backup constraints.

9) AI Features (future; active only if you enable them)

  • What AI does. Optional AI may provide writing assistance (generation, chat, agent).
  • Data handling. We may store prompts, assistant chats, and outputs to improve Zeyn, including personalization and better context for your projects. We do not authorize third-party model providers to train on your data by default. (Vendors may process data to provide the service; see Privacy Policy.)
  • Controls. We may offer in-app controls for history retention and project-level context.
  • Beta disclaimer. AI and experimental features may be inaccurate, incomplete, or hallucinate. Use editorial judgment. See §15 for warranty limits.

10) Intellectual Property & Feedback

  • Zeyn IP. The Service, brand, and software are owned by us or our licensors.
  • Feedback. If you give feedback, ideas, or survey responses, you grant us a perpetual, worldwide, royalty-free license to use them to improve Zeyn. We may request permission to quote testimonials.

11) Device Use & Access Controls

  • Personal license. Your license is personal and non-transferable.
  • Devices. No explicit device cap at present; we may introduce reasonable device limits (e.g., one active device) with notice.
  • Access management. We may use technical measures to manage plan limits or prevent fraud/abuse.

12) Third-Party Services

Zeyn integrates or may integrate with third-party services (e.g., Stripe, EasyCart, PostHog, Sentry, Supabase, Cloudflare, AI providers). Their terms and privacy practices apply to their components. We may update subprocessors and integrations over time.

13) Sanctions, Export Controls & Restricted Regions

You must comply with applicable sanctions and export-control laws. You may not use or access the Service in or from jurisdictions or by persons subject to prohibitions under EU/UK/US (or other applicable) sanctions/export laws. Payments, downloads, and account creation are blocked where prohibited.
You must not circumvent geoblocks or restrictions. We may suspend or terminate accounts for violations.

14) Privacy

See our Privacy Policy for details on personal-data processing, legal bases, retention, and your rights (e.g., EU/UK GDPR). For security incidents related to future Cloud features, we aim to notify authorities without undue delay and, where feasible, within 72 hours, and notify affected users when there is a high risk to their rights and freedoms.

15) Disclaimers; Beta/AI

To the extent permitted by law, the Service is provided “as is”. AI and beta features are experimental and may produce errors or harmful outputs; you are responsible for final review. This clause does not limit your mandatory consumer rights under Polish/EU law.

16) Limitation of Liability

To the fullest extent permitted by law:

  • Our aggregate liability for all claims is limited to the fees you paid in the 12 months before the event giving rise to the claim (or €50 if no fees were paid).
  • We are not liable for indirect, special, incidental, consequential, or loss of profits, or for data loss you could have prevented via backups (local or Cloud Sync).
  • Nothing excludes liability for death or personal injury caused by negligence, fraud, wilful misconduct, or other liability that cannot be excluded under applicable law.

17) Indemnity

You agree to indemnify and hold harmless Zeyn against third-party claims, damages, and costs arising from (a) your User Content, (b) your breach of these Terms, or (c) your violation of law or third-party rights.

18) Changes, Suspension & Termination

  • Changes to Terms. For material changes, we’ll give at least 14 days’ notice via email or in-app. Continued use after the effective date means acceptance.
  • Suspension/termination. We may suspend or terminate immediately for AUP or sanctions violations, fraud, non-payment, or security risks. Otherwise, we’ll provide notice and an opportunity to cure when reasonable.
  • Effect of termination. Your license ends and access to Cloud/AI (if any) stops. You should export your data before termination; we may retain limited data as required by law or for legitimate interests (e.g., fraud prevention).

  • Vulnerability disclosure: Report security issues to rafal@piekara.me. Do not publicly disclose before we have a chance to remediate.

21) Miscellaneous

  • Entire agreement. These Terms are the entire agreement regarding the Service.
  • Severability. If a provision is unenforceable, the remainder stays in effect.
  • No waiver. Failure to enforce is not a waiver.
  • Assignment. You may not assign without our consent; we may assign as part of a reorganization or sale.
  • Governing law & venue. Polish law; courts in Tarnów, Poland.

22) Definitions (summary)

  • Service: Zeyn desktop app and related features, including optional Cloud Sync and AI.
  • User Content: manuscripts, notes, chapter structures, stats, and similar materials you create or provide.
  • LTD: Lifetime Deal for v1 desktop offline features (v1.x updates).
  • Tokens/Credits: Metered units for Cloud/AI features, if applicable.

23) Language

This English version is for convenience. The Polish version is authoritative and prevails in case of conflict.
